A Zoning Board hearing on the reconsideration request, once noticed; no date had been announced as of Nov. 1, 2026. The public may take part when a hearing is held.

The site. 150 Allen Road (Block 11201, Lot 3) is a 28.256-acre lot in the E-2 office zone between Allen Road and I-78, reached by a driveway over a residential lot. It held a 174,546 sq ft office building, which the owner demolished during the hearings.

The application (ZB22-028). Signature Acquisitions, LLC, filed in September 2022, proposed two buildings of light manufacturing and office space, 258,528 sq ft in all, later cut to 244,128, with variances including a “d(4)” floor-area variance. After 18 hearing dates, the Zoning Board denied the application 6-0 on Nov. 14, 2024 and memorialized the denial in a 93-page resolution on Feb. 5, 2025. The resolution records “more than 70 objecting members of the public” and objectors represented by counsel.

Reconsideration and the lawsuit. On Dec. 4, 2024 the applicant asked the Board to reconsider a revised plan that would bring the floor-area ratio within the 15% limit. Patch reported that the applicant withdrew that request on March 11, 2025 and sued the Board on March 27, 2025 (Signature Acquisitions, LLC v. Zoning Board of Adjustment of the Township of Bernards, SOM-L-000481-25).

The remand. Patch reported that on Sept. 29, 2026 Judge Robert Ballard ruled that the Board’s decision not to consider the timely reconsideration request was “arbitrary, capricious, and unreasonable,” and remanded the case for the Board to consider the request and revised proposal under the rules in effect when the application was filed. He did not rule on the merits of the denial. LocalWhy has not reviewed the court’s decision.

Since then. The Board’s Oct. 7 and Oct. 28, 2026 agendas list closed sessions on the litigation. TAPinto reported that no hearing was held on Oct. 7 because the applicant was not present, and that the public will be able to take part when a hearing is scheduled.
