Zoning Board of Adjustment — October 28, 2026
Special meeting for the fifth hearing on 131 Morristown Rd LLC's townhouse application (ZB25-040). The township's recording shows the motion to approve received four votes in favor and three against, short of the five a "d" variance requires, so the relief was not granted. The agenda also listed an executive session on the Signature Acquisitions lawsuit. The township had not posted minutes of this meeting as of Nov. 1, 2026.

What happened
What the record shows
The township had not posted minutes of this meeting as of Nov. 1, 2026. This page is built from the agenda, the special-meeting notice and, for one outcome only, the township’s recording. Attendance, roll calls, testimony and public participation will be added from the minutes once they are posted.
What the agenda and notice list
The Board’s special-meeting notice, dated September 18, 2026, says ZB25-040 “shall be heard during this meeting and formal action may be taken.” The agenda lists oaths of office; the September 17 minutes (marked “Adopted as drafted 10/28/2026”); the continued public hearing on ZB25-040; an executive session on pending litigation, Signature Acquisitions, LLC vs. Zoning Board of Adjustment of the Township of Bernards, Docket SOM-L-000481-25; and the 2025 Zoning Board of Adjustment Annual Report and Recommendations.
ZB25-040, 131 Morristown Rd LLC: fifth hearing
The application, for 131 Morristown Road (Block 801 Lot 2), seeks preliminary and final site plan approval, bulk variances and “d” variances for use and floor area ratio, for age-restricted townhouses in place of two office buildings. At the September 17 hearing the applicant said it would revise the plan to 125 units; revised architectural and site plans dated October 15, 2026 and Exhibit A-13 renderings dated October 28, 2026 are in the township’s application folder. The Board’s time to act had been extended to October 31, 2026.
The township’s recording of the meeting shows that the motion to approve the application received four votes in favor and three against. Under the Municipal Land Use Law (N.J.S.A. 40:55D-70(d)), a “d” variance requires the affirmative vote of at least five members, so the relief was not granted. This outcome will be checked against the minutes once they are posted. The Board’s memorializing resolution is not on its November 4 agenda. See 131 Morristown Road townhomes.
150 Allen Road litigation
The agenda listed an executive session on the Signature Acquisitions lawsuit over the Board’s denial of application ZB22-028 at 150 Allen Road, which Patch reported on Oct. 5, 2026 had been sent back to the Board by a Superior Court judge on Sept. 29, 2026 for consideration of the applicant’s reconsideration request. See 150 Allen Road.
